Terms and Conditions

1. GENERAL
 By registering for the Application (as defined below), you agree to be bound by these terms of use (“AppTerms”). Please review them carefully before registration and login.

2. DEFINITIONS
The “Application” shall mean the software provided by Knorum, Inc. (“Knorum”) to offer services for members of the ‘Ask a Stranger’ community (“Services”) on Apple iOS devices and any upgrades from time to time and any other software or documentation which enables the use of the Application.

3. DATA PROTECTION
Any personal information you supply to Knorum, Inc. when using the Application will be used by Knorum, Inc. in accordance with its Privacy Policy.

4. PROPRIETARY RIGHTS AND LICENCE
4.1. All trade marks, copyright, database rights and other intellectual property rights of any nature in the Application together with the underlying software code are owned either directly by Knorum, Inc. or by Knorum, Inc.’s licensors.
4.2. Knorum, Inc. hereby grants you a revocable worldwide, non-transferable, non-exclusive licence to use the Application in accordance with these AppTerms.

5. CONDITIONS OF USE
5.1. You will not, nor allow third parties on your behalf to (i) make and distribute copies of the Application; (ii) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate the Application; or (iii) create derivative works of the Application of any kind whatsoever.
5.2. You will not misuse the Services and acknowledge and understand that “misuse” of the Services includes, but is not limited to using the Services in any manner that (i) interferes with other’s use of the Services or with Knorum, Inc.’s ability to provide the Services; (ii) infringes the copyright, trademark or any intellectual property right; (iii) is fraudulent, unlawful or contains defamatory or illegal information, images, materials or descriptions; (iv) slanders, defames, harasses, stalks, threatens or otherwise violates the legal rights of others or is invasive of another’s privacy rights; (v) promotes or provides instructional information about illegal activities; (vi) encourages any conduct that would constitute a criminal offence or that gives rise to civil liability; (vii) uses the Services on a device without permission, regardless of whether it is a stolen, lost or unauthorized device; (viii) uses the Services with more than one registration per person or involves the simultaneous use of multiple user accounts by the same person; (ix) colludes with other users in order to manipulate the Services; (x) tampers with or makes an unauthorized connection to the network of any wireless service provider; (xi) involves reselling any part of the Services to any other individual or entity; or (xii) disseminates viruses or other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware.
5.3. The Application is currently made available to you for your personal, non-commercial use. Knorum, Inc. reserves the right to amend or withdraw the Application, or change the charges for the application or service provided to you in accordance with these AppTerms, at any time and for any reason.
5.4. You acknowledge that the terms of agreement with your respective mobile network provider (‘Mobile Provider’) will continue to apply when using the Application. As a result, you may be charged by the Mobile Provider for access to network connection services for the duration of the connection while accessing the Application or any such third party charges as may arise. You accept responsibility for any such charges that arise.
5.5. If you are not the bill payer for the mobile telephone or handheld device being used to access the Application, you will be assumed to have received permission from the bill payer for using the Application.

6. PRICES
6.1. 6.1. Several price structures are used in the Application: (i) Price of the initial download of the Application; (ii) Price of Credit package(s) that can be bought with in-app purchases; (iii) Price of extending the expiry time of points that can be bought with in-app purchases.
6.2. The price of the Application is published on each platform which the Application can be downloaded from.
6.3. The price of Credit package(s) is displayed in the Application prior to initiating an in-app purchase.
6.4. Credits can be used within the Application to execute transactions: Ask a stranger for 10 credits; chat invite for 20 credits; I can help here for 10 credits. You acknowledge that credits will be debited to your credit balance automatically after each transaction without your additional consent. In some of these cases we will offer you the chance to reclaim your transaction related credits for a limited period of time.
6.5. Knorum, Inc. reserves the right to fix, change or revoke prices any time.

7. AWARDS
7.1. Several award structures are used in the Application: (i) Credits are awarded to you for transactions within the Application; (ii) Points are awarded to you for activities within the ‘Ask a Stranger’ community.
7.2. Transactions for which Credits are awarded: registration; in-app credit purchase; in-app expiry time purchase; redeeming badges.
7.3. Activities for which Points are awarded: Receiving a badge; redeeming a badge; ‘I can help here’; ‘Ask a stranger’; chat invite; accepting a chat invite; answer to a question; for your answer being rated as useful by at least 1 other user; buying a credit package; in-app expiry time purchase; registration; being rated as useful contributor in a chat conversation. You may be notified about additionally awarded points either in the Application or through notifications on your device. You acknowledge that all of your points will expire after a defined period of time. The time until expiry is displayed by the countdown clock in the Application.
7.4. Knorum, Inc. will regularly use award promotions. Promotions can result in frequent temporary changes to award levels. Knorum, Inc. reserves the right to set, change or revoke awards and award levels any time. By using the Application you agree that your transactions and activities represent no claim to an award. We, furthermore, reserve the right to adjust your award balances or cancel them altogether in case you violate these AppTerms.

8. VIRTUAL CURRENCY
8.1. Knorum, Inc. has the right but not the obligation to distribute amounts in ‘Ask a Stranger’ virtual currency ( “AAS$” or “$” in the Application) to its users when realising income from third parties. The allocation key for the distribution of AAS$ to users is the point balance of each user.
8.2. By using the Application you agree that your transactions and activities represent no claim to AAS$s. The expiry period for AAS$ is 2 years after the last login to the Application after which date AAS$s are lost. Knorum, Inc. reserves the right to adjust your AAS$ balance or cancel it altogether in case you violate these AppTerms.
8.3. Knorum, Inc. is entitled but not obliged to redeem your AAS$ balance for real money (“Cash-out”) on future dates specified in advance by Knorum, Inc. You can submit your request for Cash-out in the Application where the deadline for submission is also displayed. In case Cash-out is offered it only applies to accounts with an account balance exceeding AAS$ 100. Knorum, Inc. reserves the right to change the minimum account balance for Cash-out any time without prior notice.
8.4. If you have decided to cash out your AAS$ balance we will convert your AAS$ balance to US$. The conversion rate used is 1 AAS$/US$. Knorum, Inc. reserves the right to change the AAS$/US$ conversion rate any time without prior notice.
8.5. Once the conversion into US$ is done Knorum, Inc. will pay you the amount calculated. You acknowledge that it is in Knorum, Inc.’s discretion to determine which payment method to use (e.g. wire transfer) of which you will be notified during the Cash-out process. For each Cash-out Knorum, Inc. is entitled to deduct an administration fee, a transaction fee and withholding taxes (if applicable). You acknowledge that it is your sole responsibility to declare your income and to pay taxes on the funds received from us. Knorum, Inc. cannot be held liable for you not declaring your income and/or you not paying all taxes in connection to your income. You also acknowledge that because of existing tax regulations in the domicile of Knorum, Inc. the maximum amount that can be paid out to private individuals is US$ 20,000 per calendar year. In case you would like to cash out a higher amount, please contact us via the feedback function in the app or the ‘Contact Us’ form on the www.askastrangerapp.com website.
8.6. Knorum, Inc. reserves the right to check your identity before initiating payments. For such purposes You might have to present a valid ID document. By not presenting such a document on request You accept that Knorum, Inc. may withhold or cancel altogether payments to You.

9. AVAILABILITY
9.1. This Application is available to handheld mobile devices running Apple iOS Operating System. Knorum, Inc. will use reasonable efforts to make the Application available at all times. However you acknowledge the Application is provided over the internet and mobile networks and so the quality and availability of the Application may be affected by factors outside Knorum, Inc.’s reasonable control.
9.2. Knorum, Inc., its group of companies and sub-contractors do not accept any responsibility whatsoever for unavailability of the Application, or any difficulty or inability to download or access content or any other communication system failure which may result in the Application being unavailable.
9.3. Knorum, Inc. will not be responsible for any support or maintenance for the Application.

10. SYSTEM REQUIREMENTS
10.1. In order to use the Application, you are required to have a compatible mobile telephone or handheld device, internet access, and the necessary minimum specifications ('Software Requirements').
10.2. The Software Requirements are as follows: Apple iOS devices running iOS 6.0-7.1; Language: English.
10.3. The version of the Application software may be upgraded regularly to add support for new functions and services.

11. TERMINATION
11.1. Knorum, Inc. may terminate use of the Application at any time by giving notice of termination to you.
11.2. Upon any termination, (a) the rights and licenses granted to you herein shall terminate; (b) all your credits, points and virtual currency balances on your user account (“Account”) will be annulled; (c) you must cease all use of the Software.
11.3 You agree that Knorum, Inc. will automatically terminate use of the Application upon your death (no survivorship clause).

12. LIMITATION OF LIABILITY
12.1. In no event will Knorum, Inc. be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind arising out of your use or access to the Application, including loss of profit or the like whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise.
12.2. Knorum, Inc. is not liable to you for any damage or alteration to your equipment including but not limited to computer equipment, handheld device or mobile telephones as a result of the installation or use of the Application.

13. INDEMNIFICATION
You agree to indemnify, defend and hold harmless Knorum, Inc., and each of its respective officers, directors, employees, agents, contractors, suppliers, successors and assigns from and against any claim, proceeding, loss, damage, liability, cost or expense (including, but not limited to, reasonable attorneys' fees and legal expenses) of any kind arising out of: (i) your access to or use of the Services or any third party content and services; (ii)  any breach by you of your obligations under this Agreement; (iii) your violation of the rights of a third party, including any infringement of any intellectual property, proprietary right or trade secret of any person or entity, or of any privacy or consumer protection right that is implicated herein; (iv) any violation of law; or (v) your negligence or willful misconduct.  These obligations will survive any termination of the Agreement. Knorum, Inc. reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify against, and you agree to cooperate in Knorum, Inc.’s defense of such matter.

14. DISCLAIMER OF WARRANTIES
To the maximum extent permitted by law, and for the avoidance of doubt, Knorum, Inc. hereby disclaims all implied warranties with regard to the Application. The Application and software are provided "as is" and "as available" without warranty of any kind.

15. ARBITRATION AGREEMENT: Please read this Arbitration Agreement carefully. It affects your rights.
Unless otherwise required by a mandatory law of a member state of the European Union or any other jurisdiction, these Agreements are subject to the law of Hungary, without regard to choice or conflicts of law principles.
